Judge denies request for expedited Ezekiel Elliott hearing

Cowboys' Ezekiel Elliott's (suspension) hearing scheduled for October 30

NY judge Katherine Polk Failla denied the NFL's request to expedite Ezekiel Elliott's suspension appeal Monday, meaning the Dallas running back will be eligible to play against the Washington Redskins in Week 8.

Judge Katherine Polk Failla of the U.S. District Court for the Southern District of NY ruled Elliott's hearing will be held, as originally scheduled, on October 30.

The NFL's six-game suspension of Elliott under its personal conduct policy remains a matter of contention in court between the league and the NFL Players Association.

The Cowboys will now head into week 8 preparing for their matchup with the Redskins in Washington. Elliott allegedly assaulted his ex-girlfriend over a six-day period in July 2016.

In its filing, the league said the NFL Players Association can not satisfy the requirements for preliminary relief, can not demonstrate a likelihood of success on the merits and hasn't shown that it, or Elliott, will suffer irreparable harm absent an injunction.

Elliott had 147 yards rushing Sunday against the San Francisco 49ers with three touchdowns, two rushing and one receiving. The NFL has not been permitted to enforce the suspension all season. He also snared 32 balls for 363 yards and another score.

But the ongoing battle has put the Cowboys in a pickle regarding the continued uncertainty regarding his availability for this season.
