However, the court cited irregularities in the conduct of the vote, with a 4-2 majority decision ruling in favour of a petition by opposition leader Raila Odinga.

The election commission had declared incumbent President Uhuru Kenyatta the victor of last month's election. "A lot of them actually belong in jail and therefore we are going to ask prosecution for all the electoral commission officials who have committed this monstrous crime against the people of Kenya", Odinga said.

However, the ruling indicated the increasing independence of Kenya's court system and may help build trust in the country's institutions over the long term, according to Gordon.

"We are ready to go back to the people with the same agenda".

Kenya, a USA ally in the fight against Islamists and a trade gateway to East Africa, has a history of disputed votes.

He had won the annulled poll by 54 per cent, polling 8,203,290 votes against Mr Odinga's 6,762, 224 (44.74 per cent). Human rights groups have said police killed at least 24 people in unrest that followed the August 8 vote.

Odinga has contested the last three elections and lost each time.

"An order is hereby issued directing the 1st Respondent to organise and conduct a fresh Presidential Election in strict conformity with the Constitution and the applicable election laws within 60 days of this determination under Article 140 (3) of the Constitution".

In a televised address to the nation, Kenyatta said he disagreed with the court's ruling but would respect it.

The commission, he said, would make internal changes ahead of the repeat poll.

In court, Odinga's lawyers said the irregularities affected five million votes. In Nairobi's sprawling Kibera slum, where six had died in clashes following the election, residents poured out of their homes and danced holding Odinga posters. He said the forms also were not signed, as required to ensure accountability.

Paul Muite, the electoral commission's lawyer, argued during the hearing that the integrity of the vote had been protected "as far as was humanly possible".
