10-year-old girl given right to have abortion by Indian court

An Indian court will decide whether a 10-year-old Indian girl left pregnant after she was repeatedly raped should be allowed to have an abortion, police said Tuesday.

The district court will take a call on the matter on Tuesday, the police said. PGIMS medical superintendent Dr Ashok Kumar Chauhan, however, said their report was confidential and would be revealed only to the police.

The law in India does not allow the termination of pregnancy after the 20th week, unless the woman's life is at risk.

On Saturday night, a young woman was abducted while returning to her home in the New Delhi suburb of Gurgaon and gang raped by three men in a moving auto before being set free the next morning, police said.

India's Supreme Court has received several petitions from rape victims in recent months requesting terminations and each case has been referred to a panel of medical experts.

The mother had alleged that the girl's stepfather had threatened the victim with dire consequences if she dared to disclose it to anyone.

A minor girl from Rohtak has sent a letter to the police alleging rape and blackmail by two persons at gun-point. She said she already had four children. "The victim has been given counseling and necessary medical care, and her statement was recorded before a magistrate", Nain said. The woman's head was smashed with a brick and a vehicle run over her before the body was dumped. She died two weeks later at a hospital in Singapore.

Police said the men took turns raping the woman, using an iron rod to violate her as the bus drove around the city for nearly an hour.

She later became known as Nirbhaya, or the "fearless one", and her case led to protests across India coupled with intense media coverage and scrutiny over the country's problem of sexual violence against women.
